TERMS AND CONDITIONS

 

Registration is legal and binding even without the signature of the participant. By booking the registrant affirms for himself and for all other registered participants that they are aware of the general terms and conditions and accept them.

The minimum age to participate at The Lake Pole Camp is 18.

 

Fees

The fees are understood as per person and will be stated in US dollars. The price of participation includes the selected lodging (single-, double- -triple or shared room), including full board with beverages (water, coffee or tea), the participation in 12 hrs of workshops as well as the use of all hotel areas.  Transportation from and back to The Lake Pole Camp location - Antigua Guatemala is also included on the price. Alcoholic beverages, massages, purchases on-site, wifi, are not included.

 

Terms of Payment

Full Payment: All payments will be made via PayPal with PayPal account or credit card, or by bank transfer to a US bank account or to a UK bank account. After successful registration and payment is done the participant will receive an automatic email confirming his spot at The Lake Pole Camp.

Flexible Payment: After registration and payment of deposit, each participant will be sent an Invoice by e-mail with the outstanding balance.  The balance due on the invoice will be divided in 3 instalments which must be paid via PayPal or bank transfer within 90 days of the date of the invoice. The amount of each payment will be determined by the package chosen.

Within 4 months of the start date of The Lake Pole Camp, there will no longer be the option to pay by Flexible Payments. The registration must either be closed by this date or the participants will be only offered the option of Full Payment. 

If a participant fails to pay any amount due under the invoice on the due date, The Lake Pole Camp reserves the right to cancel the participants spot and booking on the event and re sell the spot to another participant. No refund or transfer of credit of any payments made shall be reimbursed.

 

Cancellations, Re-booking, No-show

 

The Booking will be considered ‘cancelled’ by The Lake Pole Camp when a participant, by written notification to the e-mail address thelakepolecamp@gmail.com, cancels the entire  booking.

In the event of cancellation for any reason, The Lake Pole Camp shall have the right to impose a cancellation charge which shall be calculated as detailed below:

 

60 - 89  days before pole camp : 50% of total cost. 

30 - 59 days before pole camp : 75% of total cost. 

29 days before pole camp : 100% of total cost. 

 

On cancellation for any reason, the participant shall immediately pay to The Lake Pole Camp all of the cancellation charges as provided above less any amounts already paid.

Deposits are non-refundable

Cancellation charge applies for cancelling at any time during instalments (Flexible payment)

 

If the participant notifies 90 days or more prior The Lake Pole Camp start date, The Lake Pole Camp will offer a TRANSFER OF CREDIT or REFUND on other payments made, minus a deposit fee of US$500 regardless of the payment option chosen. The participant is responsible for the fees incurred of transferring the money back to his account.

 

If the participant notifies less than 89 days before The Lake Pole Camp start date The Lake Pole Camp will NOT provide a REFUND but will offer a TRANSFER OF CREDIT on other payments.

 

Transfers to another person is allowed for an administration fee of US$150 and only up to 16 days prior to the start date of The Lake Pole Camp.

The participant will need to notify by email if they want to transfer their spot to another person. 

 

If a participant who was planning to share a double or triple room with another decides to cancel, the remaining participant will bear the added costs for the re-booking based on the room category (e.g. the difference in price between a double room to a single room). 

 

If the participant has not checked in by 12:00 pm on the first day of the event at the meeting point, and has not notified The Lake Pole Camp that he will be arriving late at least 3 days before the camp starts, this will be treated as a "No-Show" and will result in the claim to the room for the entire duration of the stay being forfeit and a 100% cancellation fee being charged. This rule applies regardless of the reason for the cancellation.  

 

No refund will be given if the participant starts late or leaves early The Lake Pole Camp.

 

TRANSFER OF CREDIT

When elegible, the participant may transfer any amounts paid to a future retreat. This can either be chosen at the time of notification, or a credit can be held and the participant may decide later which Retreat he or she will like to use it for.

 

REFUND

When elegible, The Lake Pole Camp will issue the refund via PayPal or bank transfer. The participant will be responsible for the fees incurred of transferring the money back to his account.

 

MINIMUM NUMBERS

The Lake Pole Camp requires a minimum of 14 participants to go ahead. If the minimum number of participants isn't met, and The Lake Pole Camp does not proceed, all payments will be refunded.

 

LIABILITY

Travel insurance is compulsory for all participants attending The Lake Pole Camp. Evidence of coverage must be provided prior to The Lake Pole Camp start date. No liability will be accepted in the event of injuries or accidents during The Lake Pole Camp or transportation to the event.  Participation in The Lake Pole Camp is entirely at the participants own risk. Any existing diseases, injuries or bodily complaints must be communicated to the instructors before each workshop starts. No liability will be accepted for theft or loss of personal property.

 

Cancellation of Event

Changes in the sequence as well as in the course of The Lake Pole Camp program are possible at all times. 

In the event that The Lake Pole Camp is cancelled, the sum already paid will be refunded to the participants within 4 weeks.

The Lake Pole Camp shall be excused from performance and shall not be in default in respect of any obligation hereunder to the extent that the failure to perform such obligation is due to a Force Majeure Event. 

“Force Majeure” means any circumstance beyond the control of The Lake Pole Camp including, but not limited to acts of God, fire, explosion, adverse weather conditions, flood,

earthquake, failure of energy sources or transport network, terrorism, riot, civil commotion, war, hostilities, strikes, work stoppages, slow-downs, or other industrial disputes,

accidents, riots or civil disturbances, acts of government, lack of power, non-performance or delays by suppliers or materials shortages.

The Lake Pole Camp shall not be liable to the other of loss or damages arising from prevention or delay in performance of this Contract where same is a result of Force Majeure.

For the avoidance of doubt, nothing shall excuse the participant from any payment obligations under this contract.

If The Lake Pole camp is prevented or hindered from hosting the event by a Force Majeure event, The Lake Pole Camp may, at its sole option and without being liable for any loss or

damage suffered by the participant, relocate the event to another location or terminate the Contract forthwith by giving notice to that effect to the participant.

 

Information/Data

Information and data belonging to the participant and used by The Lake Pole Camp for delegate registration purposes will remain the sole property of the participant. Except with the express written permission of the participant or if required by law or regulation, The Lake Pole Camp will not disclose or use this information for any purpose other than those associated with the event service.

 

Copyrights and Use Rights of Photos and Video Recordings

All participants who are present during The Lake Pole Camp may be photographed and/or filmed. These recordings can be used for promotional purposes on all publicity or advertising related to The Lake Pole Camp and www.yourpolecamp.com website. Publicity like flyers, newspaper reports, magazines, Facebook, Instagram and other social media-channels applies.  By registering the participants expressly give their consent to publication without compensation of any photos or film recordings made of them.

 

Court of Jurisdiction

Guatemalan law shall govern this contract and the parties to this contract submit to the exclusive jurisdiction of the Guatemalan courts.
